Abstract

Non-contractual land use affects in particular the land kept by the Agricultural Property Stock of the State Treasury, managed by Agricultural Property Agency (APA). The management of the described phenomenon by APA has some weak points, which hampers the solution of the problem (e.g. lack of availability of complex and single statistical data for APA units). A review of the collected materials shows that there are hardly any solutions which are targeted at the largest group of the illegal land users, i.e. ex-tenants (83% in 2014). The analysis of the above mentioned phenomenon also points to the existence of the agency dilemma. One can observe characteristic conflicts of interests resulting from asymmetry of information. Non-contractual use of agricultural area is one of the consequences thereof.
